Do we need to be in the EU?

No. What matters is that you can act before the courts that have jurisdiction over the flight, which can include the UK and other countries.

Fees and cost arrangements are agreed individually with each partner before any case is referred.

Who stays in contact with the passenger?

We remain the passenger's point of contact unless agreed otherwise, so you can focus on the legal work.
